Texts From Pets, LLC (“we,” “us,” or “our”) provides the Texts From Pets website, mobile application, and related services (collectively, the “Service”). These Terms of Service (“Terms”) govern your use of the Service.

1. Who can use Texts From Pets
Texts From Pets is designed for parents and legal guardians — not for direct use by children. Only adults aged 18 or older may create accounts, subscribe, manage profiles, and provide consent on behalf of a child. By creating an account, you confirm that you are 18+ and that you are the parent or legal guardian of any child whose profile you create.

2. How the Service works
Parents voluntarily provide limited child-related information so we can generate playful, parent-delivered messages “from” a pet. Children do not directly interact with the AI. AI-generated messages are created for entertainment purposes and delivered to the parent or guardian-controlled account or device. SMS messages are sent only if the parent has opted in.

3. SMS/Text Messaging Program
Texts From Pets offers an optional recurring SMS/text messaging program for parents who affirmatively opt in. Messages may include personalized pet messages and related service or account communications.

Message frequency varies. Message and data rates may apply.

Consent to receive SMS messages is optional and is not a condition of purchase or account creation. Providing a mobile phone number alone does not constitute consent to receive SMS messages.

You may reply STOP to opt out at any time. After you opt out, you will not receive further SMS messages unless you provide new consent or reply START where supported. Reply HELP for help or contact hello@textsfrompets.com.

Wireless carriers are not liable for delayed or undelivered messages. Our Privacy Policy applies to information collected through the SMS program.

4. Free Early Access and payments
Texts From Pets may offer the Service through a Free Early Access period during which no payment is required. If paid features or subscriptions are offered in the future, applicable pricing and payment terms will be presented before purchase.

5. Third-party service providers
Texts From Pets may use trusted third-party service providers to operate the Service, including Twilio for message delivery, Supabase for cloud infrastructure/database services, and OpenAI for AI-generated content support. If paid features or subscriptions are offered, Stripe or another payment provider may process payments. These providers may process limited information only as needed to provide their services to Texts From Pets.

6. Service availability
We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. Temporary interruptions may occur due to maintenance, technical issues, third-party provider outages, or circumstances beyond our control.

7. Limitation of liability
To the fullest extent permitted by law, Texts From Pets, LLC is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of data, unauthorized access, service interruptions, emotional distress claims, third-party provider failures, or issues arising from AI-generated entertainment content.

8. Dispute resolution — please read carefully
We hope we never have a disagreement, but if we do, we want a simple, fair way to handle it. You and Texts From Pets, LLC agree that any dispute relating to these Terms or the Service will be resolved by binding individual arbitration, not in court, except that either of us may bring an individual claim in small-claims court.

You and Texts From Pets agree that any claims must be brought on an individual basis only. You waive the right to participate in a class action, class-wide arbitration, or representative proceeding. These Terms and any dispute are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules.

9. Parent rights — review, correction, deletion
Parents may request review, correction, or deletion of child-related information at any time by contacting hello@textsfrompets.com.

10. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service or by email.
